Terms of Use and Legal Conditions - Escapp
Welcome to Escapp (https://escapp.es), a web platform for creating and conducting educational escape rooms. The following Terms of Use and Legal Conditions (hereafter "Terms and Conditions") govern access to and use of this platform and the services it provides. By accessing or using Escapp, you agree to these Terms and Conditions and to the platform’s Privacy Policy. If you do not agree to these Terms and Conditions or the Privacy Policy, please do not use Escapp.
1. Definition of Key Terms
- Author: a registered user authorized to create, upload, and host content on the platform.
- Content: any text, information, escape room, escape room element, resource, webpage, image, or file of any kind.
- Platform: refers to the web platform called ESCAPP accessible at https://escapp.es and the services it provides.
- Provider: refers to the University of Eastern Finland.
- User: any person accessing the platform, whether registered or not.
- Registered user: any person who accesses the platform and has registered on it.
2. Identifying information of the platform owner
The platform is managed by the University of Eastern Finland, with registered office at YLIOPISTONRANTA 1 E, PC 70211, KUOPIO, Finland, and Business Identification Number 2285733-9.
3. Terms of Use
- The platform is available at https://escapp.es and is free to use.
- Any user may register on the platform. However, registration as an author is reserved only for persons expressly authorized by the provider. The provider reserves the right to revoke this authorization at any time and at its sole discretion, without any right to compensation or indemnity for the affected user.
- Users agree to use the platform and its content in accordance with the law, morality, good customs, and public order.
- The information provided by users regarding their accounts must be truthful, accurate, and complete.
- Usernames may not consist of words or expressions identical to trademarks, trade names, corporate or advertising names, or artistic names of third parties, all of which are protected by intellectual or industrial property laws, nor may they be offensive, racist, xenophobic, or generally offensive to others or contrary to morality and good customs.
- Users are solely responsible for maintaining the confidentiality of their access password and must bear any harm resulting from its breach, disclosure, or misuse.
- The provider may require users to verify their email address and may limit or block access and use of the platform until verification is completed.
- Users must always respect the rights of third parties and agree to actively cooperate with the provider in identifying and reporting any conduct that violates these Terms and Conditions or applicable laws.
- Users are solely responsible for any content they generate, transmit, host, distribute, communicate, make available, link, embed, or display through the platform. They must fully comply with all applicable data protection, privacy, image rights, and intellectual and industrial property laws, holding the provider harmless from any related claims. The provider shall in no case be liable for opinions expressed by users on the platform, nor for content linked, embedded, generated, or stored by them, nor for the consequences, accuracy, completeness, reliability, or legality of such content.
- The provider may implement features and use technologies it deems appropriate to prevent any defamatory, racist, sexist, xenophobic, discriminatory, pornographic, violent, or otherwise unlawful or inappropriate content on the platform.
- The provider may limit the server space (storage capacity) allocated to each registered user for their content.
- A user who owns an escape room may use personal data of participants provided by the platform solely for the purposes indicated in the Privacy Policy.
- A registered user may unsubscribe from the platform, but the provider reserves the right to delete or retain any content linked, embedded, generated, or stored by that user, as well as to retain anonymized personal data.
- The provider reserves the right, at its sole discretion and at any time, to delete, remove, or refuse to publish any content linked, embedded, generated, or stored by a registered user, without the user being entitled to any compensation or indemnity.
- The provider reserves the right to deny, restrict, suspend, or cancel a registered user's access to the platform and to cancel or delete their account at any time and at its sole discretion, if it deems or suspects a violation of the Terms and Conditions or if the account remains inactive for a certain period. This shall not entitle the user to any compensation or indemnity.
- The provider shall not be liable for the improper functioning of the platform or for any damages resulting from its use. The provider does not guarantee that the platform is free of errors, interruptions, viruses, or harmful elements, and shall not be liable for any damage or loss resulting from access to or use of the platform. In no event shall the provider be liable for indirect, incidental, special, punitive, consequential, or any other damages (including, but not limited to, loss of profits, data loss, or service interruption) resulting from the use or inability to use the platform or its content, even if the provider has been advised of the possibility of such damages.
- The provider may suspend or close user registrations temporarily or permanently for technical or security reasons, without entitlement to claims or compensation.
- The provider may temporarily interrupt or suspend access to the platform, without entitlement to claims or compensation.
- The provider may permanently discontinue the platform and delete all stored data without incurring any liability.
4. Data Protection
The processing of personal data is carried out in accordance with Finnish and European data protection laws, including the General Data Protection Regulation (GDPR). For more information, please refer to our Privacy Policy.
5. Use of Cookies
Only essential cookies are used to ensure the proper functioning of the web platform. Tracking or third-party cookies are not used. You can find more information about the cookies used by the platform in our Cookie Policy.
6. Jurisdiction
These Terms and Conditions are governed by the laws of Finland and the European Union (EU). Any dispute, controversy, or claim arising out of or related to these Terms and Conditions or the use of the platform shall be subject exclusively to the jurisdiction of the Courts and Tribunals of the city of Helsinki, except where otherwise required by applicable law. In case of doubt, Finnish law shall always prevail.
7. Updates to the Terms and Conditions
We reserve the right to update these Terms and Conditions in the future. Continued access to or use of the platform after any modifications take effect constitutes your acceptance of those changes. We will notify users of any significant changes to these Terms and Conditions or to the Privacy Policy via email or through the platform.
